Your Pre-Inspection Agreement: What It Is, Why It Matters, and How to Get It Right

Every home inspection begins before you set foot on the property. You coach your clients on their scheduling call. You research the property. And, most importantly, you have them sign your pre-inspection agreement.
This single contract can mean the difference between a manageable claim and a costly legal battle. Whether you're a seasoned inspector or just starting out, understanding what a pre-inspection agreement is and how to use it correctly is essential to protecting your business.
What is a pre-inspection agreement?
A pre-inspection agreement is a legally binding contract between you, the home inspector, and your client. It defines the scope, terms, and limitations of the inspection before any work begins. It sets expectations on both sides—clarifying what will and won't be inspected, how disputes will be handled, and what clients should do if something goes wrong.
Think of it as your first line of defense. A well-written agreement protects your business. It also builds trust with clients by being transparent about the inspection process from the start.
Key Considerations for Your Pre-Inspection Agreement
Not all pre-inspection agreements are created equal. Here are five important things to keep in mind when writing, editing, or using yours.
1. Include the right provisions.
Your agreement should include the following clauses:
- Inspection scope.
- Exclusions.
- Limitation of liability.
- Statute of limitations.
- Dispute resolution.
- Arbitration.
- Severability.
Missing even one of these provisions can leave you exposed. But pay close attention to your state's specific requirements, since some provisions are not allowed in every state. Also, some states mandate certain language or disclosures.
2. Get it signed before you start.
We can’t stress this enough. Your pre-inspection agreement is only enforceable if it's signed before the inspection begins. A signed agreement obtained after the fact is far less likely to hold up.
Make it a nonnegotiable part of your process to have every client sign the agreement before you walk through the door.
3. Use clear, plain language.
Overly complex legal jargon can confuse clients. It may actually work against you if a judge or jury finds the terms unclear.
Aim for straightforward language that clients can read, understand, and agree to confidently.
4. Review and update regularly.
Laws change. Industry standards evolve. Your agreement should evolve, too.
Set a reminder to review your agreement at least annually and any time there's a significant change in your state's inspection regulations or case law affecting home inspectors. You’ll also need to tailor your scope if you’re performing add-on services like pest or mold inspections, or anything that deviates from a standard inspection.
5. Don't try to write it alone.
Drafting a legally sound contract without professional guidance is risky. A poorly worded clause can be worse than no clause at all.
So always work with your attorney or insurance provider when making major changes to your agreement.
